All the legal side of registering a trademark is dealt with by the Department for Trade and Industry (DTI). They produce a document 'Trade Marks' that you can get from the internet. You will need to have Adobe Acrobat Reader to download this document which you can get free from the Internet. There are two categories of trademarks recognised in the UK. These are registered trademarks and unregistered trademarks. The difference between a registered trademark and an unregistered trademark is to do with how you want to use it in your business.

If you want the trademark to be regarded as a separate asset and not part of your business rather than as a sign for your label then you have to register it. You should decide whether you think it is worth registering it separately before you set up the company or if you can wait until the company is working and register it as a trademark which just represents the label.Trademark law

Under the trademark act from 1994, your trademark registration will last for ten years at which point you will have to register it again. Of course registering a trademark is not free and you will need to check the rates on the 'Trade Marks' document DTI has provided.
